HKOCC Waiver and Release of Liability

In consideration of being allowed to participate in the Outrigger activities and sport (“activities” covers all participation in training, racing and any other team physical activity; sport refers to the same) with the Hong Kong Outrigger Canoe Club (Hereafter known as the HKOCC) program described below, acknowledges, appreciates, and agrees that:  

1. There is risk of injury from the activities involved in this sport and while particular rules, equipment, and personal discipline may reduce the risk, the risk for injury and even death or paralysis does exist. These risks include, among other things:

• Water - water of any temperature increases the hazard of physical injury, hypothermia and drowning. Where there are currents, there are increased risks of collision with rocks and of spills.
• Weather - weather conditions on the can change rapidly and without warning.
• Slippery Rocks – canoes sometimes have to be carried over rough terrain increasing the risk of injury; likewise, paddlers sometimes must cross slippery rocks to arrive at and get in the boats.

2. I confirm that I can swim a distance of no less than 100 meters unassisted and confirm that I have been made aware that life preservers are available to all paddlers at all times on and off the water.
 

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
4. I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official (team leader, coach, or steersman) AS WELL as paddlers immediately; and,
5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the HKOCC, their officers, agents, employees, and other participants, with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by the negligence of the releasees or otherwise.

I agree this agreement shall be governed in all aspects by and interpreted in accordance with the laws of the HONG KONG SAR.

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND CONFIRM IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
